Terms of Service

These Terms of Service ("Terms") govern your use of the Pulse website at onthepulse.app and related services (the "Service") operated by Pulse ("we", "us", "our"). By accessing or using the Service you agree to be bound by these Terms. If you do not agree, please do not use the Service.

1. Eligibility

You must be at least 13 years old to use the Service. By using the Service you confirm that you meet this age requirement. If you are under 18 you must have the consent of a parent or legal guardian.

2. Your account

To access certain features you must create an account. You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You agree to notify us immediately at hello@onthepulse.app if you suspect any unauthorised use of your account.

You may not use another person's account without permission. We reserve the right to suspend or terminate accounts that violate these Terms.

3. Pulse Pro subscription

Pulse Pro is a paid subscription that removes ads and unlocks premium features. Subscriptions are billed monthly or annually in advance. Payments are processed by Stripe. You can manage or cancel your subscription at any time via your account settings; cancellation takes effect at the end of the current billing period.

We do not offer refunds for partial billing periods except where required by applicable law (e.g. UK Consumer Contracts Regulations 2013). If you cancel within 14 days of initial purchase and have not substantially used the premium features, you may request a refund by contacting hello@onthepulse.app .

4. Event listings and accuracy

Pulse aggregates event information from third-party sources including Ticketmaster, Eventbrite, Skiddle, and DICE. We do not organise, host, or sell tickets to events. Event details including dates, times, prices, and availability are provided for informational purposes only and may not always be accurate or up to date.

We are not responsible for any loss or inconvenience caused by inaccurate event information. Always check directly with the event organiser or ticketing provider before travelling or purchasing tickets.

5. Affiliate links

"Buy Tickets" links on Pulse are affiliate links. When you purchase a ticket through one of these links we may receive a commission from the ticketing partner. This does not affect the price you pay. We only link to reputable ticketing platforms and we are transparent about our affiliate relationships.

6. Acceptable use

You agree not to:

• Use the Service for any unlawful purpose or in violation of any applicable law or regulation
• Scrape, crawl, or systematically extract data from the Service without our prior written consent
• Interfere with or disrupt the integrity or performance of the Service
• Attempt to gain unauthorised access to any part of the Service or its infrastructure
• Upload or transmit any content that is defamatory, obscene, harmful, or infringes any third-party rights
• Use the Service to send unsolicited communications (spam)
• Impersonate any person or entity

7. Intellectual property

The Service, including its design, code, editorial content, and branding, is owned by Pulse and protected by copyright, trademark, and other intellectual property laws. You may not reproduce, distribute, or create derivative works from any part of the Service without our express written permission.

Event data sourced from third parties is subject to the intellectual property rights of those providers. Pulse does not claim ownership of third-party event listings.

8. Privacy

Our collection and use of personal data is described in our Privacy Policy , which forms part of these Terms. By using the Service you consent to our data practices as described there.

9. Disclaimers

The Service is provided "as is" and "as available" without warranties of any kind, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or free of harmful components.

Nothing in these Terms shall exclude or limit our liability for death or personal injury caused by our negligence, fraud or fraudulent misrepresentation, or any other liability that cannot be excluded or limited under applicable law.

10. Limitation of liability

To the fullest extent permitted by law, Pulse's total liability to you for any claims arising out of or relating to the Service shall not exceed the greater of (a) the amount you paid to us in the 12 months preceding the claim or (b) £50.

We shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or goodwill, arising from your use of or inability to use the Service.

11. Third-party services

The Service contains links to third-party websites and services. These are provided for your convenience and do not constitute our endorsement. We have no control over third-party services and are not responsible for their content, privacy practices, or terms of service.

12. Changes to the Service

We reserve the right to modify, suspend, or discontinue any part of the Service at any time with or without notice. We will not be liable to you for any modification, suspension, or discontinuation.

13. Changes to these Terms

We may update these Terms from time to time. If we make material changes we will notify you by email or via a prominent notice on the Service. Your continued use of the Service after the updated Terms take effect constitutes acceptance of the new Terms. The "Last updated" date at the top of this page reflects the most recent revision.

14. Governing law

These Terms are governed by and construed in accordance with the laws of England and Wales. Any disputes arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts of England and Wales.
